ALTURA does not guarantee specific results, including but not limited to return on ad spend (ROAS), cost per acquisition (CPA), conversion rates, traffic volumes, or revenue outcomes. Advertising performance is influenced by numerous factors beyond ALTURA’s control, including market conditions, competition, platform algorithm changes, client product/market fit, and budget constraints.
ALTURA shall not be liable for damages arising from third-party platform outages, policy changes, account suspensions, or data loss caused by Google, Meta, or any other advertising or technology platform.
7.Payment Terms
Payment terms, including fees, billing frequency, and payment methods, will be specified in the applicable SOW, proposal, or service agreement. Unless otherwise stated:
- Invoices are due upon receipt or within the period specified in the service agreement (typically net 15 days).
- Late payments may incur a late fee of 1.5% per month (or the maximum rate permitted by law, whichever is lower) on the outstanding balance.
- ALTURA reserves the right to suspend or terminate services for accounts with outstanding balances exceeding thirty (30) days past due, after providing written notice.
- Advertising spend (media budgets paid directly to Google, Meta, or other platforms) is separate from ALTURA’s service fees and is the sole responsibility of the Client, unless explicitly agreed otherwise.
- All fees are non-refundable once services have been rendered, unless otherwise specified in the applicable service agreement.
8.Termination
